New Waterfront Restaurant Gets Approval for More Outdoor Dining
Hampton City Council approves permit for changes at planned restaurant along Sunset Creek


On August 13, Hampton City Council approved a use permit that will allow Fishers Landing Eats to open a new restaurant with expanded outdoor dining at 4330 Kecoughtan Road. The decision clears the way for a 1,026-square-foot establishment featuring both indoor seating, as well as an outdoor bar with expanded outdoor dining overlooking the waterfront.
The permit was granted with nine conditions to balance business operations with neighborhood compatibility. Key requirements include:
Operating hours: Indoor and outdoor dining can operate daily from 5 a.m. to midnight.
Noise control: Music and sound must comply with city noise limits.
Capacity limits: The restaurant cannot exceed occupancy set by the city’s building official.
Visibility: Windows must remain transparent so the interior is visible from outside during business hours.
Licensing: All required business and alcohol licenses must be maintained, and state ABC rules must be followed.
Permit expiration: The permit automatically ends if ownership, management, or operations change, or if alcohol sales lapse for more than three months.
Compliance: All federal, state, and local laws must be observed, with violations considered grounds for revocation.
Revocation clause: The city retains the right to revoke the permit if conditions are not met.
Time limits: The permit expires if the restaurant is not established within one year or sits unused for two consecutive years.
The site, once home to a different restaurant, is zoned for light manufacturing but requires a special permit for outdoor dining. City planners noted that the project aligns with Hampton’s long-term plans to encourage mixed-use and water-oriented development along Sunset Creek, while also supporting small business growth and tourism.
With approval secured, the next steps include completing renovations and obtaining the necessary state and local licenses. Once those are finalized, Fishers Landing Eats is expected to bring a new waterfront dining option to the Kecoughtan corridor.
